It’s tragic such a bright mind can fall prey to rooting for an inferior baseball team, the Boston Red Sox. While he is a debate champion, he cannot rebut the virtue of the Yankees World Series Win, and must result to pejorative attacks comparing the Yankees to an evil empire. Very sad indeed.

On the more important point, if you don’t like the trend of the states’ being more and more dependent on federal funds from statutes that set conditions that require states to do things that they cannot be required by the federal government to do because of the Eleventh Amendment as interpreted in Hans and by the Rehnquist Court, then the answer is to revert to the original meaning of that Amendment, which was to deprive the federal courts of diversity jurisdiction in actions against states.
